Summary

In this wrongful death litigation proceeding, plaintiff Brisa Alvarez alleged County of Stanislaus of negligence by not closing the Eastin Road even though the County official knew that Orestimba Creek floods the road during storms, due to which 41-year-old father, Hector Alvarez drowned when the plaintiff and her father were driving down the flooded road and their car swamped. Defendant’s counsel claimed that Mr. Alvarez’s autopsy report showed a blood alcohol level of 0.26 percent, 3 times more than the limit under law percent and even though he wasn’t driving his intoxication resulted in profound impairment of judgment and performance.

The plaintiff was represented by attorney David Renteria. The defendant in this case, County of Stanislaus was represented by attorney D. Lee Hedgepeth.
