Summary

In this Government election law litigation proceeding, plaintiff Kevin Ambler alleged Jim Norman, the winner of the Republican primary for the Florida Senate, District 12 in August 24, 2010 of filing inaccurate financial disclosure forms to get on the ballot. In the complaint, the plaintiff, the nominee for the Republican party for the Florida Senate, District 12, asked the court to order the Elections Canvassing Commission of the State of Florida 1) to declare void the result of the election and 2) to declare and certify the plaintiff as the only duly qualified Republican candidate for the seat.

The plaintiff was represented by attorneys Edward Early, Joseph Donnelly and Mark Herron. The defendant in this case, Elections Canvassing Commission of the State of Florida was represented by attorneys Christopher Lunny, Daniel Brown, Ronald Labasky and Robert Brazel.

Outcome

The court found that Jim Norman did not properly qualify for nomination or election and was therefore ineligible and removed from the ballot of the 12th District for Florida Senate. The Division of Elections had to show a neutral, plain, and concise notice informing voters of the new nominee for the 12th District.
