Summary

Summary judgment motion in a mechanic's employment discrimination suit based on disability. The plaintiff was unable to lift more than 50 pounds.

Defendant asserted that plaintiff had made a dispositive admission in stating that United Airlines believed that the plaintiff could not perform his job duties. According to the defendant, this admission precluded the plaintiff from establishing discriminatory intent.

The Court determined that there were fact issues as to whether a reasonable accommodation could have been offered consistent with the plaintiff's physical limitation, despite the defendant's contention that the plaintiff had been offered five different accommodations.
