Plaintiff suffered two fractures of his right leg and ankle on October 19, 2007, after he fell while attempting to move aluminum deck chairs that had been improperly loaded with a forklift onto a flat bed trailer that the plaintiff had brought to Walt Disney World's property control department. Although plaintiff was a Disney employee he was not acting within the scope of his employment when the injury occurred.
The jury found damages of $215,872.44, and apportioned negligence equally between the plaintiff and the defendant.
