Summary

These are post-trial oral arguments concerning a request for final judgment and injunction. This suit, alleging breach of non-competition agreement, arose after Concord Steel Inc. acquired Wilmington Steel Processing.

Outcome

Defendants WSP and Neary breached the non-competition covenant. As a result of this breach, Concord was entitled to a permanent injunction against WSP and Neary effectively extending the restrictions of that covenant until September 12, 2011. Also, WSP and Neary were found jointly and severally liable for: (1) damages to Concord in the amount of $553,512 for their breach of the covenant; and (2) ConcordÂ’s reasonable attorneysÂ’ fees and expenses in connection with this litigation. To the extent Concord purported to assert any claims against Woislaw, those claims were dismissed with prejudice.
