Summary

In this Energy Toxic Torts class action litigation proceedings, plaintiffs Woodrow and Elva Dillon alleged Massey Energy and its subsidiaries of negligence and creating a public nuisance by building a coal silo 235 feet away from the Marsh Fork Elementary school, which exposed the plaintiff’s two children and several other children to toxic coal dust.
