Jazmin Espana was hit and killed by a garbage truck while crossing a street. Espana's family sues Republic Services, claiming that their driver failed to obey traffic laws.
Attorneys for Espana argue that Julio Cortez-Solano failed to appropriately yield while making a right turn. Additionally, they highlight that Cortez-Solano had a history of safety violations while driving for the company, warranting a finding of punitive damages.
Republic Services disputes these claims, asserting that Cortez-Solano had the right of way and checked to make sure the crosswalk was clear before beginning his turn. And, while the company admits that Cortez-Solano had a history of safety violations, representatives for the company argue that these were not associated with driving.
Verdict for Plaintiff.
Total damages: $38,764,622.58
Apportionment of fault:
Julio Solano: 43%
Republic Silver State: 15%
Republic Services: 15%
Jasmine Espana: 27%
