Plaintiff Glenn Thrash, a homeowner, filed suit against defendants State Farm; ServPro, a home repair business; and Jackie Copeland, ServPro's officer, claiming breach of the insurance contract and negligence related to the repair and cleaning of Thrash's home after a water pipe break. Thrash claimed negligent repair of the home led to the growth of mold in the dwelling. State Farm claimed that it had complied with its coverage under the contract and that ServPro functioned as an independent contractor for which State Farm was not liable.
The jury found in favor of defendant State Farm in Thrash's breach of contract claim and also found that Servpro was not the agent of State Farm. The jury found in favor of Thrash in his negligence claim against ServPro, awarding $177,919.33 and apportioning 40% fault to Thrash and 60% to Servpro.
