Summary

In this retail negligence litigation proceeding, plaintiffs Brandon Hinton and Rachelle Hinton alleged Costco Wholesale Corporation of being negligent in handing over specialized commercial machinery to an inexperienced employee which caused Brandon Hinton to suffer from a broken wrist, when an employee at the Costco retail outlet lost control of shopping carts. The plaintiffs claimed that the broken wrist broke up their marriage. The plaintiff’s counsels argued that in order to save himself Brandon Hinton tried to block the shopping carts while being on the driver’s seat of his car.
