In this Energy Mergers and acquisitions litigation class action injunction hearing, plaintiff New Jersey Building Laborers Pension Fund a minority stockholder sought to preliminary enjoin the merger of Messy Holdings with Alpha Natural Resources. The plaintiffs alleged that Massey Holdings and its senior management of not negotiating in good faith in its $8 billion merger with Alpha and claimed that the merger was unfair because the derivates claim relating to a mine explosion were not properly considered while the company was being valued by the directors of Massey Holdings.

The plaintiff was represented by attorneys Kevin Abrams and Mitchell Lowenthal. The defendant in this case, Don Blankenship was represented by attorney Stuart Grant.
