Summary

Plaintiff is asking for a review of a design to be labeled as not infringing on a patent. WCM entered a patent settlement with ABA stating that the design of a waste water drain, produced by ABA, would not be made or sold by ABA or any of its successors. IPS acquired ABA and redesigned the waste water drain, believeing that it no longer infringed on WCM's patent and upheld the settlement agreement.
