Haylee Kroll, age 15 at the time of trial, was allegedly born with an enterovirus infection, contracted from her mother at birth, the late diagnosis of which resulted in brain, liver, and kidney damage in the child. The mother's amniotic sac had ruptured weeks before delivery, and the mother had a fever at the time of Haylee's birth. Although the infant was placed in the neonatal intensive care unit, the doctors did not diagnose and treat the viral infection in time to prevent the damage.
The jury returned a $4.3M verdict in favor of the plaintiff.
