In this oral argument before the Delaware Supreme Court, the attorney representing defendant Ronald Luttrell contended that the lower court denied Mr. Luttrell's rights to due process and to be free from double jeopardy when it denied his motion for a bill of particulars. The lower court also denied Mr. Luttrell's motion for a new trial. Mr. Luttrell, who was convicted of attempted rape, unlawful sexual contact, indecent exposure among other charges, was sentenced to 26 years in prison followed by probation.
The Superior Court's judgment of convictions was reversed and the matter was remanded for a new trial.
