VERDICT

Trial
10/12/10 – 11/19/10

Summary

In this healthcare toxic torts class action litigation proceeding, plaintiff Marc J. Mignano (as parent and Guardian ad Litem of ISAAC J. MIGNANO, a minor) alleged Jim Sullivan, a builder of negligence by converting a former thermometer factory into a child care facility due to which the plaintiff’s child and several other children got exposed to mercury vapors. The plaintiffs assert that the building's owners, as well as local, county, and state agencies, should be responsible for any injuries that result from having allowed the contaminated facility to be converted to a child care center.

The plaintiff was represented by attorney James Pettit. The defendant in this case, Jim Sullivan was represented by attorney Catherine Jasons.

Outcome

The court found that the state, the county, Franklin Township, and the building owners were negligent. They were ordered to fund 1.5 million to provide long-term medical monitoring to the babies and children who attended Kiddie Kollege Day Care.
