Summary

The City of Milwaukee sued the National Lead Industries and the Mautz Paint Co. to recover $53 million dollars for lead-based paint removal within the city. The City claimed that the defendants created a public nuisance because they marketed and sold substantial quantities of lead pigments and/or lead-based paint. The City also alleged conspiracy and sought compensatory and punitive damages.

The jury found that the presence of lead-based paint in and on houses in the city was a nuisance, but the defendant National Lead Industries did not intentionally, unreasonably, or negligently cause the nuisance.
