Via The Albuquerque Business Journal: "It’s been a long time coming, but it appears the legal battle between two giants of the extractive industries in Eddy County will be decided by a state district court jury come December.

The case was filed by Mosaic Potash in 2010, accusing Devon Energy Production Co. of trespassing on two sections of land within a mineral lease held by Mosaic, the Carlsbad Current-Arugs reported. Devon’s drilling in that area allegedly caused damages to the potash deposits. Further, gas and oil drilling too close to a potash mine creates a risk that methane may enter the underground work areas and cause an explosion or other problems, according to court documents."
