Summary

In this real estate litigation proceeding, plaintiff Resort Properties of America, a sole proprietorship owned by real estate broker David Atwell alleged Richard Alter and his firm of not paying the due 2% commission for the purchase of a Las Vegas Resort Hotel. The plaintiff’s counsels claimed that instead of paying the plaintiff, Mr. Alter paid a $2M broker’s commission to a “fake broker” intermediary, and then transferred it back to himself.

The plaintiff was represented by attorney William Kemp. The defendant in this case, Cherry Investment and Development Co was represented by attorney Rex Garner.
