Summary

In this Engle progeny tobacco litigation proceeding, plaintiff Arthur W. Rohr (personal representative of the estate of Arthur Rohr) alleged R.J. Reynolds Tobacco Company and Philip Morris Tobacco Co. of fraudulent concealment of dangers of smoking cigarettes manufactured by the companies, which led the plaintiff’s father Arthur Rohr to get addicted to smoking at an early age. The plaintiff also alleged the companies of manufacturing defective cigarettes, which caused Mr. Rohr’s death due to lung cancer at age 86, in the year 1995. However, according to the defense, Mr. Rohr was in complete control of his smoking, could have quit any time, and actually died of a skin cancer (malignant melanoma) that spread to his lung.

The plaintiff was represented by attorney Bruce Denson. The defense in this case comprised of R.J. Reynolds Tobacco Company and Philip Morris Tobacco Co. R.J. Reynolds Tobacco Company was represented by attorneys Dennis Murphy, Stephanie Parker, Michael Rosenstein, and Robert Walker. Philip Morris Tobacco Co was represented by attorneys Sandra Ezell, William Geraghty and Daniel Molony.
