Summary

In February 2011, Michael Galliher died from mesothelioma. In an amended complaint filed July 6, 2011, his wife Darcel Galliher brought suit individually and as special administrator of his estate. She alleged that 16 defendants were liable for his death, including R.T. Vanderbilt Company, Inc, an industrial talc producer. The suit claimed that Vanderbilt failed to warn about workplace exposures to industrial talc that allegedly cause Mr. Galliher's disease. In this oral argument before the Delaware Supreme Court, Vanderbilt appealed a jury verdict against the company for nearly $3 million in damages.

Outcome

The judgment of the Superior Court was reversed, and the matter was
remanded for a new trial.
