Summary

In this oral argument before the Delaware Supreme Court, the issue on appeal was whether the lower court's denial of defendant William Sells' motion for severance an abuse of discretion. On September 6, 2011, Mr. Sells was arrested and charged with offenses related to an alleged bank robbery at the First National Bank of Wyoming on August 26, 2011. On April 10, 2013, a motion to sever, requesting a separate trial from co-defendant Russell Grimes was filed on behalf of Mr. Sells. On April 19, 2013, Mr. Sells' motion to sever was denied. A second motion to sever, on different grounds, was filed on May 1, 2013. Defendant's trial began on May 7, 2013. On May 9, 2013, the defendant's second motion to sever was denied.
