In this oral argument before the Delaware Supreme Court, counsel of plaintiff Kingsley Simendinger challenged the Superior Court's decision granting motion for summary judgment filed by National Union Fire Insurance Company, the workersÂ’ compensation insurance carrier of Connections CSP, Inc. The interpretation and applicability of 19 Del. C. Sec. 2363(e) and its interplay with the contract of insurance between Connections CSP, Inc. and Philadelphia Indemnity Insurance Company is at the core of the dispute between the parties. On February 25, 2010, Christopher Sturmfels and Michael Kriner were killed in an automobile collision. At the time of the collision, both Mr. Sturmfels and Mr. Kriner were working for Connections. Connections owned the vehicle in which the decedents were travelling when the accident occurred and had purchased an Underinsured Motorist insurance policy for the vehicle issued by Philadelphia.
The judgment of the Superior Court was reversed and this matter was remanded for further proceedings.
