Swindle v. IAP Worldwide Services

Hearing on motion for summary judgment in advancement of attorney fees.

Plaintiff, the former president of IAP Worldwide (a company that provides aviation services for the State Dept and other federal government agencies) sought from IAP the advancement of legal fees incurred in response to a federal grand jury investigation by the Justice Department, of which the plaintiff was a subject.

The issue before the court was whether the plaintiff's response to the investigation constituted "defending a proceeding" even though there had so far been no indictment or target letter.
