Webre v. Destin West Beach and Bay Resort

VERDICT

Trial
06/24/25 – 06/26/25

Summary

In this premises liability trial, Emily Webre was staying at Destin West Beach and Bay Resort for her college fall break. On her way to the parking garage, Webre tripped and fell over a one-inch cement step. Webre sues the resort, claiming that this step was in violation of Florida codes and posed a serious danger to guests.

Webre's attorney, Nicholas Rowley, argues that the step violated the local building code, which mandates elevation changes greater than a quarter inch to be smoothed over. This fall, he claims, caused Webre to suffer a broken ankle and will likely limit her mobility for the rest of her life.

Grayson Miller, representing West Beach and Bay Resort, suggests that Webre tripped over her flip-flop and may have been intoxicated at the time. Miller also states that the step was reasonably safe, and a finding that it violated building code does not automatically mean the resort was negligent.
